The New Mexico business community is mourning the sudden passing of David Leyva, a well-known Jersey Mike’s franchise owner whose life was cut short in a tragic rollover crash early Saturday morning, October 4, in the town of Mesilla. He was reportedly visiting one of his restaurants in Las Cruces when the fatal incident occurred.
According to the Mesilla Marshal’s Office, deputies responded to a 911 call around 2:30 a.m. after a white BMW crashed near the water fountain in a city park. Investigators say Leyva, who was the only occupant, failed to make a curve on southbound Calle de Paso, causing the vehicle to hit a curb, go airborne, and overturn three times before coming to rest near the fountain.
Authorities confirmed that Leyva was not wearing a seatbelt and succumbed to his injuries while being transported to a hospital. Toxicology results are pending.
In a public notice, the Marshal’s Office also warned residents about online scammers attempting to exploit the tragedy by claiming to have videos of the crash—urging the public not to engage with such fraudulent links.
